Family Law

Sometimes circumstances change that make the original orders for custody or support difficult to implement.  Income levels can change for better or worse, the needs of the children can result in increased costs or require the custodial parent to spend less time at work and more time at home, or a parent may need to move out of state for work.  The law provides a mechanism for modifying orders when appropriate, and our office can assist in initiating or challenging modifications.

Paternity, also known as parentage, is the process of establishing the legal father of a child who is born to unmarried parents.  Oftentimes, paternity is voluntarily acknowledged; in other cases, paternity is disputed and genetic testing and a court trial is required.  Establishing paternity gives the legal father rights to custody and visitation; it also creates a responsibility for financial support.  Furthermore, establishing paternity can sometimes extinguish parental rights that were assumed by another.  We can help navigate these thorny issues and represent clients in establishing or challenging paternity.

Domestic violence has implications in both the criminal and family law arenas.  Not only is a domestic violence batterer subject to criminal sanctions, including jail time in most instances, but domestic violence can lead the family court to award sole custody and prohibit visitation, or even remove a minor to temporary custody by an extended family member.

The primary legal weapon against domestic violence is the injunction or restraining order, which can restrain a person from living with or having contact with another, order a person into treatment or counseling, or establish temporary support orders.  Our practice includes seeking or challenging injunctions, and our attorneys understand how domestic violence can be implicated in a divorce proceeding regarding orders for custody and support.

Our experience in civil and criminal litigation gives us the ability to handle almost any type of case that arises, including appeals.  Our criminal law and family law practices again cross paths in the juvenile arena, where we represent juveniles and families in both delinquency and dependency matters.  Juvenile Dependency Court hears cases when there is a concern that a child has been or is in immediate danger of being abused, abandoned, or neglected, and can result in termination of parental rights.  A guardian ad litem is usually appointed to represent the child, while the parents have the right to retain a lawyer to advise and represent them throughout the case.
