Divorce Mediation in Boca Raton

When couples can agree on the terms a divorce, they have a better chance of emerging with an amiable relationship that, among other things, can result in unified parenting of the children.  Naturally, ending a marriage is not a time when spouses are likely to be in full agreement.  But, if they can come to partial agreement—and if they want to avoid the stress of a contested divorce, divorce mediation is a critical tool for Boca Raton couples to negotiate terms that can result in the best future for everyone involved.

How Divorce Mediation Works

When Boca Raton couples enlist a divorce mediator prior to taking the case to divorce court, they have an opportunity to determine their own future—before a judge makes decisions that may differ from their own.  In essence, both spouses, represented by their own Boca Raton divorce lawyers, negotiate their case before an impartial mediator who intercedes in any areas of disagreement.  Divorce mediation may or may not result in full agreement.  But, it does reduce the areas of dispute before taking the case to court, giving both spouses greater control in their futures.

How Boca Raton Courts Are Involved in Divorce Mediation

If Boca Raton couples achieve full agreement in divorce mediation, the courtroom process becomes largely administrative, and it no longer involves a divorce mediator in Boca Raton.  The judge must review the agreement, and, if he or she finds areas of concern, these areas might be subject to the traditional process of a courtroom divorce before the judge makes a final decision.

Similarly, if couples cannot agree in all areas, the judge hears both cases before reaching a decision for the areas of dispute only.  Once all details are ironed out, the judge approves and finalizes the divorce, leaving couples to begin their new lives apart.
