Uncontested Divorce in Boca Raton

What Boca Raton Couples Should Know About Uncontested Divorce

An uncontested divorce always requires both parties to negotiate the terms that go into effect once the divorce is finalized.  These terms include how property is to be divided and spousal support, if appropriate.  And, when children are involved, questions of parenting must be resolved including child custody, visitation, and support.

Two types of uncontested divorce are typical:

  • Mediated divorce:  Spouses and their attorneys can negotiate the terms of their divorce in front of an impartial mediator, who helps them come to agreement in areas of concern.  A mediated divorce does not always result in full agreement—but it provides couples with the chance to retain control in as many areas as possible before turning other decisions over to the family court.
  • Collaborative divorce:  This form of divorce is relatively new, requiring that both collaborative attorneys have training in a unique process.  It involves a series of meetings between both spouses, their attorneys, and a team of psychological, financial, and other specialists needed to resolve all issues of the divorce before having it approved by a judge.  But, if negotiations break down, couples are required by law to hire different attorneys before pursuing a more traditional form of divorce.
